§1 Scope of application
The deliveries, services and offers of the online shop www.louisxvi.ch are made exclusively on the basis of these terms and conditions, even if they are not expressly agreed again.
With the order of the commodity these conditions apply as accepted.
Deviations from these terms and conditions are only valid if confirmed in writing.
§2 Offer and Conclusion of Contract
The information in our onlineshop (drawings, illustrations, mass, weights, etc.) are to be understood as guideline values and do not represent a guarantee of properties, unless they are expressly stated as binding in writing.
The prices stated on the homepage are decisive.
The prices are incl. 8.0% VAT excl. Shipping costs.
§4 Delivery and performance time
If the desired product is in stock, the delivery time is 2-10 days. Whether a product is in stock can be seen in the product information.
If a product is not available, the delivery time stated by us is subject to the correct and timely delivery to us and our suppliers.
If the ordered goods can no longer be delivered by the supplier or manufacturer, the buyer has the right to choose. He may either withdraw from the contract or opt for another product of the same price class.
In no event shall delivery delays be grounds for damages or a right to withdraw from the contract.
The shipping costs are shown separately and amount to CHF 9.00 for Switzerland.
If the customer does not indicate anything to the contrary on the order, we reserve the right to make complete or partial deliveries.
§ 5 Acceptance Delay
If the purchaser refuses to accept the purchase item after expiry of an extended period of grace or if he declares that he does not wish to accept the item of purchase, www.louisxvi.ch may demand compensation for non-fulfillment.
Visible quantitative differences must be indicated in writing immediately in the case of goods retention, hidden differences in the quantity within 4 days after receipt of goods www.louisxvi.ch and the freight carrier (post office).
Complaints regarding damage, delay, loss or poor packaging are to be reported immediately upon receipt of the goods dispatch.
§7 Transfer of risks
The risk passes to the buyer as soon as the consignment has been handed over to the person carrying out the transport. If the shipment is delayed or becomes impossible due to no fault of www.louisxvi.ch, the risk shall pass to the buyer with the notification of readiness for dispatch. A transfer of the transport costs www.louisxvi.ch agreed in the individual case has no influence on the passing of the risk.
The warranty under the following provisions is 2 years for manufacturing defects, unless otherwise expressly agreed in writing.
Consumables are excluded from warranty.
The warranty is void if the defect is due to improper use, storage and handling of the goods by the buyer.
Insignificant deviations from assured properties of the goods do not trigger any warranty rights.
No liability is accepted for normal wear and tear parts.
Warranty claims against www.louisxvi.ch are only for the immediate buyer and are not assignable.
For returns, www.louisxvi.ch requires that the defective product with a detailed error description as well as a copy of the invoice be carefully returned.
The shipping costs for the return are to be borne by the buyer.
The replacement of parts or products does not lead to any new warranty periods. The warranty is limited to the repair or replacement of the damaged items.
www.louisxvi.ch has no obligation to store any of its customers. Should a customer not pick up a repair item 3 months after completion or refuse acceptance, the customer can either be disposed of or sold at the discretion of www.louisxvi.ch to cover the repair costs. There is no claim to the product after the deadline.
Warrants are to be understood exclusively as purchase vouchers and in no case claim to reimbursement.
There is no right to cash repayments or reimbursements.
The purchase prices are to be settled in the payment terms specified by www.louisxvi.ch.
Discounts are excluded.
§11 Limitation of Liability
Claims for damages arising out of impossibility of performance, for breach of contract, from fault at the time of conclusion of contract and from tortious act are expressly excluded both against www.louisxvi.ch, as well as against fulfillment and / or vicarious
